IF YOU ARE DISABLED AND ENTITLED TO SOCIAL SECURITY DISABILITY, WHO MAKES THE DECISION?

Completing a disability claim can be a lengthy process. To be considered disabled for social security purposes, you must
Be unable to do any substantial work because of your physical or mental condition(s); and
Your physical or mental condition(s) must last, or be expected to last, at least 12 months (1 year), or be a terminal illness that is expected to result in your death.
Medical evidence (treatment records and diagnostic tests) are required to support your disability claim. Social Security Disability is awarded only to people judged to be totally disabled, There is no provision for a “partial” Social Security Disability.

SOCIAL SECURITY BENEFIT TYPES

Claimants may receive two types of Social Security Administration benefits:
• Supplemental Security Income (SSI) for people who have not worked enough to be considered “insured” for SSDI purposes, and who currently have little or no income and resources.
• Social Security Disability Insurance (SSDI), which is for “insured” workers, their disabled surviving spouses and children (disabled before age 22) or disabled, retired or deceased workers;
